Municipal services recovery actions.

(a)

A city or town that operates a trash or recycling collection service, municipal waterworks or sanitary sewer system shall not collect or attempt to collect past due payments from a property owner for any of those services through any means when the property owner has not contracted with the city or town for provision of the service.

(b)

When a tenant resides on a property and the property owner does not reside on the property, the city or town, as a condition of providing trash or recycling, water or sewer service, shall not require the property owner to contract with the city or town for provision of any of those services. Each city or town shall adopt appropriate policies to implement this section.

Section 2

Nothing in this act shall be construed to modify or impair any existing contract or obligation between a property owner and a city or town executed before the effective date of this act.

This act is effective July 1, 2021
