A JOINT RESOLUTION

for

A JOINT RESOLUTION proposing to amend the Wyoming Constitution to impose term limits on the state offices of senator, representative, governor, secretary of state, treasurer, auditor and superintendent of public instruction.

BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF WYOMING,
two-thirds of all the members of the two houses, voting separately, concurring therein:

Section 1.

The following proposal to amend the Wyoming Constitution, Article 3, Section 2 and Article 4, Sections 2 and 11 is proposed for submission to the electors of the State of Wyoming at the next general election for approval or
rejection to become valid as a part of the Constitution if ratified by a majority of the electors at the election:

Article 3, Section 2.

Members' terms and qualifications.

(a)

Senators shall be elected for the term of four (4) years and representatives for the term of two (2) years. The senators elected at the first election shall be divided by lot into two classes as nearly equal as may be. The seats of senators of the first class shall be vacated at the expiration of the first two years, and of the second class at the expiration of four years. No person shall be a senator who has not attained the age of twenty-five years, or a representative who has not attained the age of twenty-one years, and who is not a citizen of the United States and of this state and who has not, for at least twelve months next preceding his election resided within the county or district in which he was elected.

(b)

No person shall be eligible to stand for election or appointment as a senator if the person by the end of the
current term of office for which the person was elected or appointed will have served, or but for resignation or removal would have served, a total of twelve (12) or more years in the Wyoming senate. No person shall be eligible to stand for election or appointment as a representative if the person by the end of the current term of office for which the person was elected or appointed will have served, or but for resignation or removal would have served, a total of ten (10) or more years in the Wyoming house of representatives.

Article 4, Section 2.

Qualifications of governor; term limit.

No person shall be eligible to the office of governor unless
he be
the person is
a citizen of the United States and a qualified elector of the state, who has attained the age of thirty years, and who has resided 5 years next preceding the election within the state or territory, nor shall
he
the person
be eligible to any other office during the term for which
he
the person
was elected.
No person shall be eligible to stand for election or appointment as governor if the person by the end of the current term of office as governor will
have served, or but for resignation or removal would have served, a total of eight (8) or more years as governor.

Article 4, Section 11.

State officers; election; qualifications; terms.

There shall be chosen by the qualified electors of the state at the times and places of choosing members of the legislature, a secretary of state, auditor, treasurer, and superintendent of public instruction, who shall have attained the age of twenty-five (25) years respectively, shall be citizens of the United States, and shall have the qualifications of state electors. They shall severally hold their offices at the seat of government, for the term of four (4) years and until their successors are elected and duly qualified. The legislature may provide for such other state officers as are deemed necessary.
No person shall be eligible to stand for election or appointment as the secretary of state, auditor, treasurer, or superintendent of public instruction if the person by the end of the current term of office for which the person was elected or appointed will have served, or but for resignation or removal would have
served, a total of eight (8) or more years in the same elected office.

Section 2.

That the Secretary of State shall endorse the following statement on the proposed amendment:

The adoption of this amendment will impose term limits for state senators and state representatives, the governor, secretary of state, auditor, treasurer and superintendent of public instruction. If a person will have served, or but for resignation or removal would have served, a total of twelve (12) or more years in the Wyoming senate, a total of ten (10) or more years in the Wyoming house of representatives or a total of eight (8) or more years in the same statewide elected office, the person would not be eligible to be elected or appointed again to that office.
