Air ambulance transportation memberships and subscriptions; required disclosures; penalties
.

(a)

As used in this section, "air ambulance transportation membership and subscription" means a contract, certificate or other agreement under which, in exchange for fees, dues, charges or other consideration, a person provides access to providers of air ambulance transportation services and the right to receive air ambulance transportation services from those providers.

(b)

All air ambulance transportation memberships and subscriptions offered in this state shall be provided in writing.

All memberships and subscriptions and related written advertisements and marketing materials shall contain the following language highlighted in bold in not less than twelve (12) point type:

This agreement for air ambulance transportation services is not an insurance contract and is not regulated, monitored or reviewed by the Wyoming Department of Insurance.

The business practices and
financial condition of the person or company offering this agreement may not be reviewed or regulated by the Department of Insurance.

Any person who violates this section is subject to the penalty provided in W.S. 26

"Disability insurance" defined.

(a)

Disability insurance is insurance of any kind on human beings against:

(ii)

Disablement or expense resulting from sickness

Section 3.

The department of insurance shall promulgate any rules necessary to implement the provisions of this act.

Section 4.

This act applies to air ambulance transportation memberships and subscriptions issued, renewed or amended on or after the effective date of this act.

Section 5

This act is effective immediately upon completion of all acts necessary for a bill to become law as provided by Article 4, Section 8 of the Wyoming Constitution.
