A BILL

for

AN ACT relating to public health and safety; authorizing grants to community health centers and rural health clinics as specified; repealing a sunset date; providing for rulemaking authority; providing an appropriation as specified; and providing for an effective date.

Be It Enacted by the Legislature of the State of Wyoming:

Community health centers and rural health clinics; process for grants facilitating capital construction and
start up
costs; account established; grant criteria.

(d)

The department shall provide grants, subject to the following:

(vi)

Grant applicants shall provide proof of designation as a rural health clinic or federally qualified community health center;
and

(viii)

Other grants may be made to community health centers and rural health clinics under this section as authorized by the legislature for the period prescribed by the legislature.

Section 3.

(a)

Grants may be awarded to existing community health centers and rural health clinics under W.S. 9
‑
2
‑
127 using funds from and subject to any limitations imposed by the Coronavirus Aid, Relief, and Economic Security (CARES) Act, P.L. No. 116
‑
136, or from any other available federal funding.

Grants awarded under this section may be used to cover expenses incurred in response to the public health emergency caused by COVID
‑
19 or to improve the state's health care delivery system and infrastructure, including major renovations or capital construction of facilities.

(b)

Grants to any one (1) community health center or rural health clinic under this section shall not exceed four hundred thousand dollars ($400,000.00). The requirements specified in W.S. 9
‑
2
‑
127(d)(i), (iv) and (vi) shall not apply for the purposes of this section.

(c)

For purposes of this section:

(i)

"Community health center" means:

(A)

A health center receiving federal funding under section 330 of the Public Health Service Act,

P.L. No. 78–410, including health centers serving migrant and homeless populations;

(B)

A community mental health center providing services for the care and treatment of mentally ill patients under a cooperative contract with the department of health as provided by W.S. 35

(ii)

"Rural health clinic" means a certified rural health clinic as documented by the centers for Medicare and Medicaid services.

(d)

The department of health shall promulgate any emergency and regular rules necessary to implement this section.

Section 4.

There is appropriated to the department of health any federal funds designated by the governor for the purpose of the grants authorized under W.S. 9-2-127.

Section 5.

This act is effective immediately upon completion of all acts necessary for a bill to become law as provided by Article 4, Section 8 of the Wyoming Constitution.
