AN ACT relating to crimes and offenses; amending the relationships required for the crime of incest; amending the penalty for incest; and providing for an effective date.

Be It Enacted by the Legislature of the State of Wyoming:

402(a)(i) through (iii), by creating new paragraphs (iv) and (v) and (b) is amended to read:

Incest; penalties; disclosure or publication of identifying information; "minor victim".

(a)

A person is guilty of incest if he knowingly commits sexual intrusion, as defined by W.S. 6

301(a)(vii), or sexual contact, as defined by W.S. 6

‑
301(a)(vi), with an ancestor or descendant or a brother or sister of the whole or half blood. The relationships referred to herein include relationships of:

(i)

Parent and child
or siblings
by adoption
when one or both of the adopted siblings is a minor and living in the same household
;

(ii)

Blood relationships without regard to legitimacy;
and

(iii)

Stepparent and stepchild
.

or step siblings when one or both of the step siblings is a minor and living in the same household;

(iv)

Legal guardian and child or persons with the same legal guardian when one or both of the persons with the same legal guardian is a minor and living in the same household; and

(v)

Foster parent and foster child or persons with the same foster parent when one or both of the persons with the same foster parent is a minor and living in the same household.

(b)

Incest is a felony punishable by
:
imprisonment for not more than fifteen (15) years, a fine of not more than ten thousand dollars ($10,000.00), or both.

(i)

Except as provided in paragraph (ii) of this subsection, imprisonment for not less than five (5) nor more than twenty (20) years and a fine of not more than ten thousand dollars ($10,000.00), or both;

(ii)

If the person is eighteen (18) years of age or older and the victim is less than eighteen (18) years of age, imprisonment for not less than twenty

five (25) years nor more than fifty (50) years and a fine of not more than ten thousand dollars ($10,000.00), or both.
