A BILL
for
AN ACT relating to the Wyoming lottery; authorizing scratch-off ticket games; providing for the distribution of net proceeds attributable to scratch-off ticket games; creating an account; requiring funds in the account to be expended to support outdoor recreation as specified; making conforming amendments; authorizing the adoption of regulations; providing applicability; and providing for effective dates.

Outdoor recreation office funding account; deposit of scratch

off ticket game proceeds; administration.
There is created the outdoor recreation office funding account. The state treasurer shall credit to the account those funds attributable to scratch
‑
off ticket games as specified under W.S. 9
‑
17
‑
111(b). Interest and other earnings on funds within the account shall be credited to the account. Funds in the account shall be expended by the department of state parks and cultural resources upon appropriation by the legislature to support outdoor recreation areas and facilities.

103.
Definitions.
(a)
As used in this chapter:
(vi)
"Lottery," "lotteries," "lottery game" or "lottery games" means any game of chance approved by the board and operated pursuant to this chapter, specifically limited to a state lottery
,

a
multi

lottery and state and multi
‑
state scratch
‑
off ticket
games, and shall not include
other
instant tickets,
scratch
‑
off tickets,
video lottery terminals or any other electronic game involving direct physical contact between the player and a machine;

108.
Adoption by board of procedures regulating conduct of lottery games.
(a)
The board may adopt regulations, policies and procedures regulating the conduct of lottery games in general, including, but not limited to, regulations, policies and procedures specifying:
(i)
The type of games to be conducted, specifically limited to a state lottery
,
or
a multi
‑
state lottery
,
and state and multi
‑
state scratch
‑
off ticket games
and shall not include
other
instant
‑
win tickets,
scratch
‑
off ticket games,
video lottery terminals or any other electronic game involving direct physical contact between the player and a machine;

Disposition of lottery proceeds.
(b)
On or before the fifteenth day of each quarter, the corporation shall transfer to the treasurer's office, for credit to the lottery account which is hereby created, at least seventy
‑
five percent (75%) of
the
all lottery game
net proceeds from the preceding quarter. Final reconciliation of the transfer to the state under this subsection shall be determined at the end of each fiscal year based on the audited annual financial statements.
Net proceeds attributable to scratch
‑
off ticket games shall be accounted for separately from all other net proceeds.
Upon their deposit into the account, any monies representing a deposit of net proceeds shall then become the unencumbered property of the state of Wyoming and the corporation shall have no power to agree or undertake otherwise.
At least once per fiscal year, net proceeds attributable to scratch
‑
off ticket games credited to the lottery account
shall be paid by the state treasurer to the outdoor recreation office funding account created by W.S. 9
‑

‑
129.
At least once per fiscal year,
these monies
all other net proceeds credited to the lottery account
shall be paid by the treasurer to the treasurers of the counties, cities and towns for payment into their respective general funds. The percentage of the balance that will be distributed to each county and its cities and towns will be determined by computing the percentage that sales of lottery tickets collected by retailers in each county including its cities and towns bear to total sales of lottery tickets collected by retailers in all counties including their cities and towns.
This percentage of the monies shall be distributed within each county as follows:

111(b) made by this act shall apply to net proceeds attributable to scratch
‑
off ticket games generated on or after January 1, 2023.
Section 4.
The Wyoming lottery corporation shall take action as necessary to bring scratch
‑
off ticket games to
market by January 1, 2023 or as soon thereafter as is practicable, including conducting market research, creating a launch strategy and distribution methodology and adopting regulations, policies or procedures relating to the conduct of scratch
‑
off ticket games.
Section 5
.
(a)
Except as provided in subsection (b) of this section, this act is effective January 1, 2023.
(b)
Sections 4 and 5 of this act are effective immediately upon completion of all acts necessary for a bill to become law as provided by Article 4, Section 8 of the Wyoming Constitution.
