(a)

In consultation with the commission and the Wyoming trails advisory council, the department may purchase lands and appurtenant buildings in the name of the state of Wyoming to provide suitable quarters for the state trails program field office for the support of the state trails program under W.S. 36

108(b)(iv) and of the department in carrying out its powers and duties as prescribed by law.

(b)

The department shall have authority for the supervision, operation, management and control of the state trails program field office building purchased under this section. Any expenses associated with the supervision, operation, management and control of the building, including for ordinary repairs and maintenance, shall be paid out of the snowmobile trails account created by W.S. 31

703(c) subject to legislative appropriation and in proportion to the costs incurred in administering the snowmobile trails program and the Wyoming off

road recreational vehicle trails program.

(c)

The department, in consultation with the commission, shall have the authority to lease and enter into contracts with any persons upon terms and conditions as the department deems appropriate for the supervision, operation, management and control of the state trails program field office building. The department may lease portions of the state trails program field office building for use by third parties and shall collect rents and payments arising from the occupancy of those portions of the building subject to the rules of the department. Funds received by the department under this subsection shall be deposited into the snowmobile trails account created by W.S. 31

road recreational vehicle trails account created by W.S. 31

703(c) in proportion to the amount that each account contributes under subsection (b) of this section.

(d)

The department, in consultation with the commission and the Wyoming trails advisory council, shall have the authority on behalf of the state to sell the state trails program field office building and to execute any document of title necessary to convey title to the building provided:

(i)

The sale is made for adequate consideration and complies with all statutory requirements;

(ii)

Proceeds of the sale shall be credited into the snowmobile trails account created by W.S. 31

road recreational vehicle trails account created by W.S. 31

‑
703(c) in proportion to the amount that each account contributed under subsection (b) of this section.

(e)

The department, in consultation with the commission, is authorized to adopt rules and regulations relative to the repair, maintenance, operation, management and use of the state trails program field office building. The department shall use the rules adopted by the state
building commission under W.S. 9

107(d) as guidelines for the management of the building. The department shall provide the assessment required by W.S. 9
‑

‑
107(a) through (c) to the state building commission for inclusion in the commission's report to the legislature.

(f)

As used in section:

(i)

"Commission" means the Wyoming parks and cultural resources commission;

(ii)

"Department" means the department of state parks and cultural resources;

(iii)

"State trails program field office building" means real property and any appurtenant buildings located on the property that is purchased by the department as authorized by subsection (a) of this section.

(b)

For the purpose of this subsection the term "agencies" does not include the University of Wyoming, community college districts, or school districts. It does not include the
department of state parks and cultural resources under W.S. 36

department of transportation except as to paragraphs (xi), (xii) and (xiii) of this subsection. The department through the general services division shall:

Duties and responsibilities with respect to state buildings; state capital construction needs assessment and priorities.

(e)

Rules and procedures adopted under this section by the state building commission shall be applicable to all state owned buildings unless the operation, management and use of the building has been assigned by statute to a specific state agency. The agency responsible for the
operation and management of a state building exempted by the provisions of this subsection, shall provide the assessment required by subsections (a) through (c) of this section to the state building commission for inclusion in the commission's report to the legislature. The rules adopted by the commission under subsection (d) of this section shall be used as guidelines for the management of state buildings assigned by statute to other state agencies including the
department of state parks and cultural resources
under W.S. 36

124 for the supervision, operation, management and control of the state trails program field office building, the
University of Wyoming, community college districts, department of transportation, game and fish commission and state institutions.

Snowmobile user fee; amount of fee; disposition of fees; account created; duties of department of state parks and cultural resources; duration of decal; exemptions.

(c)

There is hereby created a snowmobile trails account.

Except as provided in this subsection, the monies
collected under this section and forwarded to the department of state parks and cultural resources shall be deposited in the account created by this section and may be expended by the department subject to approval by the legislature for the administration of the snowmobile trails program
, including for the purposes specified in W.S. 36

. All voluntary fees collected under paragraph (h)(i) of this section shall be deposited in the search and rescue account created by W.S. 19

301(a). All fees collected under paragraph (h)(ii) of this section shall be deposited in the wildlife conservation account created by W.S. 31

Section 3.

The department of state parks and cultural resources shall report to the joint travel, recreation, wildlife and cultural resources interim committee not later than September 1, 2022 to provide an update on the purchase of any lands and appurtenant buildings as authorized by this act.

Section 4.

There is appropriated one million three hundred thousand dollars ($1,300,000.00) in unobligated funds from the snowmobile trails account created by W.S. 31

409(c) and one million three hundred thousand dollars ($1,300,000.00) in unobligated funds from the off
‑
road recreational vehicle trails account created by W.S.
31
‑
2
‑
703(c) to the department of state parks and cultural resources for the purpose of purchasing land and appurtenant buildings in accordance with W.S. 36
‑
4
‑
124(a) as created under section 1 of this act. Notwithstanding any other provision of law, this appropriation shall not be transferred or expended for any other purpose and any unexpended, unobligated funds remaining from this appropriation shall revert in equal proportion to the snowmobile trails account and the off
‑
road recreational vehicle trails account on June 30, 2023.

This act is effective immediately upon completion of all acts necessary for a bill to become law as provided by Article 4, Section 8 of the Wyoming Constitution.
