Publication of instructional material.

(a)

Not later than July 1, 2023, and each school year thereafter, each school district shall publish prominently on the school district's website the following:

(i)

A list of the learning material and activities that were used for student instruction by the school district during the preceding school year, organized at minimum by school, grade and subject area;

(ii)

Any policies or procedures governing the approval or use of the learning materials and activities utilized for student instruction by the local school board, school district administration or leadership or teachers.

(b)

To comply with this section, a school district may post and update the list of learning material and activities on an ongoing basis over the course of a school year provided the complete list is posted not later than July 1 following completion of the school year. A school district may utilize a collaborative online document or spreadsheet that allows multiple authorized users to update or make additions to posted content on an ongoing basis, provided a link to the list is publicly accessible on the school district's website.

(c)

The list of learning material and activities shall remain on the school district's website for not less than one (1) year after completion of the school year in which the learning material and activities were utilized.

(d)

Nothing in this section shall be construed to require the digital reproduction of the learning material or activities or separate reporting of individual components of learning material or activities produced as a single volume, except that digital volumes of learning material or activities that contain works by multiple authors shall be identified by a table of contents or internet addresses for each discreet learning material or activity contained within each volume.

(e)

As used in this section:

(i)

"Activities" include assemblies, guest lectures or other educational events facilitated by the school district or school, including those conducted by individuals not employed or associated with the school or school district, excluding student presentations;

(ii)

"Learning material" includes all textbooks, reading material, videos, digital material, websites, assessments and other online applications;

(iii)

"Used for student instruction" means assigned, distributed or otherwise presented to a student in any course for which a student receives academic credit or in any educational capacity in which participation of a student is required by a school or in which a majority of students for any given grade level are required to participate. "Used for student instruction" also includes any materials from among which a student is required to select one (1) or more titles, if the available selection is restricted to specific titles.
