A BILL
for
AN ACT relating to water and sewer districts; requiring water and sewer districts serving more than a specified number of taps to hold board member elections in conjunction with general elections; and providing for an effective date.
Be It Enacted by the Legislature of the State of Wyoming:

112(b) and by creating a new subsection (d) is amended to read:

112.
Subsequent elections of members of board of directors of district.
(b)
District board members shall serve for a term of four (4) years, except
as provided in subsection (d) of this section, and except
that at the first regular subsequent director election following the formation of the district there shall be elected by the voters of the district two (2) members of the board to serve for a term of two (2) years and three (3) members to serve for terms of four (4) years. Thereafter elections shall be held every two (2) years. Each director shall be a voter of the district.
(d)
Beginning January 1, 2024 any district providing services to seven hundred fifty (750) taps or more as of January 1 of a general election year shall hold all elections for the district board of directors at a general election, notwithstanding W.S. 22
‑

112(a). Upon being required to hold elections for the district board under this subsection each of the following apply:
(i)
The office of any director whose term would otherwise expire in the general election year that district board elections are first required to be held at the general election or in January of the year following shall
be voted upon at the general election and the directors' term shall expire at either the expiration of the term established by subsection (b) of this section or upon the election and assumption of office of a qualified successor, whichever is earlier;
(ii)
The term of any director who does not fall under paragraph (i) of this subsection shall expire as scheduled;
(iii)
Vacancies created by gaps in the expiration of a term and the next regularly scheduled general election shall be filled as specified in W.S. 41

(iv)
The term of office of one (1) or more directors elected at the first general election under paragraph (i) of this subsection shall be either two (2) or four (4) years, whichever is necessary to maintain the staggered terms that would otherwise be in place consistent with subsection (b) of this section.
