A BILL
for
AN ACT relating to consumer protection; prohibiting financial institutions from engaging in discrimination based on the use of a social credit score or other environmental, social justice or governmental score or metric; declaring the use of a social credit score as a deceptive trade practice; making conforming amendments; providing definitions; and providing for an effective date.

304.
Social credit scores; use prohibited; penalties.
(a)
No financial institution shall discriminate against any person or business entity based on a person's or business's:
(i)
Social credit score;
(ii)
Environmental, social, governance score or standard or any other subjective evaluation or metric related to social or environmental justice;
(iii)
Social media posts;
(iv)
Participation or membership in any lawful club, association or union;
(v)
Political affiliation;
(vi)
Employer; or
(vii)
Values
‑
based criteria similar to a social credit score.
(b)
Notwithstanding subsection (a) of this section, a financial institution may offer any person investments, products and services that include subjective standards, provided that any subjective standards used by the financial institution are fully disclosed to the person in writing and explained to the person before the person enters into a contract for investments, products or services.

Definitions.
(a)
As used in this article:
(viii)
"Social credit score" means
a score, ranking, number or other metric assigned to a person based
on the person's actions, interactions, consumer choices, lifestyle decisions and behavior that is acquired by the analysis of the person's bank and credit card activities, the person's technology use and other subjective criteria.

Unlawful practices.
(a)
A person engages in a deceptive trade practice unlawful under this act when, in the course of his business and in connection with a consumer transaction, he knowingly:
