A BILL

for

AN ACT relating to public health; authorizing grants for projects that increase trails, routes or pathways for bicycling, walking or horseback riding; providing an appropriation; and providing for an effective date.

Be It Enacted by the Legislature of the State of Wyoming:

Section 1
.

(a)

There is appropriated forty million dollars ($40,000,000.00) from the general fund to be administered as provided in this section. This appropriation shall be for the period beginning with the effective date of this act and ending June 30, 2025.

This appropriation shall not be transferred or expended for any other purpose and any unexpended, unobligated funds remaining from this appropriation shall revert as provided by law on June 30, 2025.

(b)

Ninety percent (90%) of the amount appropriated under subsection (a) of this section shall be appropriated to the Wyoming department of transportation. The funds shall be used to provide grants as provided in this subsection, provided that not more than seven percent (7%) of the amount available under this subsection may be used for administrative expenses to administer the grant program. The grants shall be administered in the same manner as the current transportation alternatives program administered by the department, provided that the grants shall:

(i)

Be available to any agency, instrumentality or political subdivision of the state;

(ii)

Require at least a twenty percent (20%) match from the applicant; and

(iii)

Only be available for the following eligible projects:

(A)

Shared use pathways or greenways;

(B)

Safe pedestrian and bicycle routes to schools;

(C)

Bicycle path networks on existing roads;

(D)

Sidewalk and crosswalk networks;

(E)

Projects to develop a walkable main street corridor; or

(F)

Active transportation plans that encourage increased transportation by walking or bicycling.

(c)

Ten percent (10%) of the amount appropriated under subsection (a) of this section shall be appropriated to the Wyoming department of state parks and cultural resources. The funds shall be used to provide grants as provided in this subsection, provided that not more than seven percent (7%) of the amount available under this subsection may be used for administrative expenses to administer the grant program. The grants shall be administered in the same manner as the current Wyoming outdoor recreation grant program, provided that the grants shall:

(i)

Be available to any agency, instrumentality or political subdivision of the state;

(ii)

Require at least a twenty percent (20%) match from the applicant; and

(iii)

Only be available for the following eligible projects:

(A)

Natural surface trails, including trails for hiking, horseback riding or mountain biking; or

(B)

Planning for active recreation projects that encourage increased hiking, biking or horseback riding.
