A BILL

for

AN ACT relating to motor vehicles; requiring vehicles to stop for pedestrians in school zone crosswalks as specified; authorizing video systems within school zones; providing for the use of video obtained from the video systems; providing a penalty; and providing for an effective date.

Be It Enacted by the Legislature of the State of Wyoming:

(f)

The following shall apply to crosswalks in school zones:

(i)

Official traffic control devices located in marked school zones may be equipped with a video system for the purpose of monitoring pedestrian safety, provided that the video system shall only operate:

(A)

Between the hours of 7:00 a.m. and 4:00 p.m.; and

(B)

On days that the school is in session.

(ii)

A recording of images produced by a video system equipped under paragraph (i) of this subsection shall be prima facie evidence of the facts contained in it. A recorded image evidencing a violation of this section shall be admissible in a judicial or administrative proceeding to adjudicate liability for the violation of this section and may be discoverable for other criminal actions. If the identity of the driver violating this section is known, the penalty for the violation shall be as provided in W.S. 31

104. If the identity of the driver of a vehicle that violates this section is unknown, the registered owner of the vehicle recorded by a video system as provided in this subsection shall be fined one hundred ninety
‑
five dollars ($195.00) provided that:

(A)

A fine issued to a registered owner of a vehicle operated by an unknown driver shall not be considered a moving violation for the purpose of suspending a driver's license under W.S. 31

‑
129 and shall not be considered a conviction under W.S. 31
‑
5
‑
1201 or as a prior conviction for any other purpose; and

(B)

It shall be a defense to enforcement of a fine issued to a registered owner of a vehicle operated by an unknown driver that the registered owner of the vehicle:

(I)

Did not provide express or implied consent to the person who was operating the vehicle at the time of the violation; or

(II)

Transferred ownership of the vehicle to a new owner prior to the observed violation.

(iii)

Recordings or images from a video system installed under this subsection shall not be a public record under the Wyoming Public Records Act, W.S. 16

205. Recordings or images made from a video system under this subsection shall be destroyed within one (1) year of the date the recording was made.
