Be It Enacted by the Legislature of the State of Wyoming:

110 by creating a new subsection (b) is amended to read:

How candidate may obtain recount; where affidavit filed.

(b)

The affidavit filed pursuant to subsection (a) of this section shall articulate sufficient facts to establish probable cause to believe that the required fraud or error occurred. If the office in which the candidate filed the affidavit determines the affidavit fails to establish probable cause, the request for a recount shall be denied and the candidate shall be notified of the denial. Any denial of a request for a recount may be appealed to a court of competent jurisdiction.
