Law enforcement-canine detection grants.

A BILL

for

AN ACT relating to law enforcement; establishing a program to fund fentanyl drug-detection canines for county, city and town law enforcement agencies; requiring rulemaking; requiring a report; providing an appropriation; and providing for effective dates.

Be It Enacted by the Legislature of the State of Wyoming:

Section 1
.

(a)

As used in this act, "law enforcement agency" includes any county, city or town law enforcement agency.

(b)

The law enforcement fentanyl drug-detection canine program is hereby created. The attorney general shall establish and administer this temporary program for the purpose of providing grants to law enforcement agencies to purchase and train fentanyl drug-detection canines or train drug-detection canines currently in service to detect fentanyl. Grants under this section should be awarded in accordance with the following:

(i)

The attorney general shall develop an application process, including required documentation and application deadlines, for law enforcement agencies to apply for grants to purchase and train fentanyl drug-detection canines or train drug-detection canines currently in service to detect fentanyl. Any law enforcement agency may apply for a grant under this section pursuant to the application process established by the attorney general;

(ii)

Upon receipt of an application, the attorney general shall review the application to determine whether the law enforcement agency is eligible to receive grant funding. The attorney general may require an applicant to submit any additional information necessary to determine eligibility;

(iii)

The attorney general shall develop criteria to evaluate and prioritize grant funding provided that any one (1) law enforcement agency shall not receive more than one (1) grant and the grant awarded shall not exceed three hundred thousand dollars ($300,000.00). All grants awarded under this section shall be expended only to purchase and train fentanyl drug-detection canines or train existing drug-detection canines currently in service to detect fentanyl;

(iv)

Upon determination that a law enforcement agency's application qualifies for funding, the attorney general shall authorize a grant under this program if funds are available;

(v)

Any decision made by the attorney general regarding program funding shall not be subject to any administrative or judicial review under the Wyoming Administrative Procedure Act.

(c)

The attorney general shall report to the joint appropriations committee and the joint judiciary interim committee regarding applications submitted and a summary of grants awarded under this program not later than June 30, 2025.

(d)

This appropriation provided in this act may be used for administrative expenses incurred while administering this act, in an amount not to exceed one percent (1%) of the amount of the appropriation.

(e)

The law enforcement fentanyl drug-detection canine program shall terminate December 31, 2024.

Applications for grants under this program shall be received by the attorney general not later than July 1, 2024. No grants shall be awarded under this act after December 31, 2024.

Section 2.

There is appropriated four million dollars ($4,000,000.00) from the general fund to the attorney general for purposes of this act for the period beginning July 1, 2023 and ending December 31, 2024. This appropriation shall only be used to make grants for purchasing or training fentanyl drug-detection canines for law enforcement agencies pursuant to this act and for administrative expenses as allowed by this act. This appropriation shall not be transferred or expended for any other purpose and any unexpended, unobligated funds remaining from this appropriation on December 31, 2024 shall revert as provided by law.

Section 3.

The attorney general shall promulgate rules necessary to administer the program authorized under this act.

Section 4.

(a)

Except as provided in subsection (b) of this section, this act is effective July 1, 2023.

(b)

Sections 3 and 4 of this act are effective immediately upon completion of all acts necessary for a bill to become law as provided by Article 4, Section 8 of the Wyoming Constitution.
