State loan and investment board-task force and study.

A BILL

for

AN ACT relating to state lands; establishing a legislative task force on state lands and investments; specifying membership, powers and duties of the task force; specifying termination of the task force; requiring reports; providing appropriations; and providing for an effective date.

Be It Enacted by the Legislature of the State of Wyoming:

Section 1
.

(a)

There is created the task force on state lands and investments. The task force shall be composed of:

(i)

Three (3) members of the house of representatives appointed by the speaker of the house. Of the members appointed under this paragraph:

(A)

At least one (1) member shall be a member of the joint agriculture, state and public lands and water resources interim committee;

(B)

At least one (1) member shall be a member of the select committee on capital financing and investments.

(ii)

Three (3) members of the senate appointed by the president of the senate. Of the members appointed under this paragraph:

(A)

At least one (1) member shall be a member of the joint agriculture, state and public lands and water resources interim committee;

(B)

At least one (1) member shall be a member of the select committee on capital financing and investments.

(iii)

One (1) member of the legislature appointed jointly by the speaker of the house of representatives and the president of the senate;

(iv)

Three (3) members appointed by the governor, who shall be voting members of the task force. Members appointed under this paragraph shall not receive salary but shall be entitled to receive per diem and mileage on the same basis and at the same rate as state employees. Members appointed under this paragraph who are government employees or public officials shall be considered on official business of their agency when performing duties as members of the task force.

(b)

The task force shall be staffed by the legislative service office.

(c)

The task force shall:

(i)

Select from among the legislative members of the task force co
‑
chairmen, one (1) from the house of representatives and one (1) from the senate;

(ii)

Study the composition, duties and powers of the state loan and investment board, including duties associated with overseeing grant and loan programs and the management of the investment of state funds and public funds of the state;

(iii)

Study the duties of the office of state lands and investments, including duties the office has associated with administering:

(A)

Grant and loan programs overseen by the state loan and investment board;

(B)

Leases and sales of state lands;

(C)

Investment decisions associated with the investment of state funds.

(iv)

Study the structure and current staffing of the office of state lands and investments;

(v)

Identify any governance issues that may be associated with the state land and investment board and the board of land commissioners;

(vi)

Solicit feedback from each member of the state loan and investment board on the topics identified for study under this subsection and afford each member of the board the opportunity to testify and provide feedback on each topic studied under this subsection;

(vii)

If the task force determines changes to the duties, powers and composition of the state loan and investment board or the office of state lands and investments are necessary, develop appropriate legislation and recommend the legislation to the appropriate interim or select committee for consideration.

(d)

The office of state lands and investments, the state treasurer's office and any other state agency shall provide information and assist the task force with the study of topics identified in subsection (c) of this section.

(e)

The task force shall terminate on January 1, 2025.

Section 2.

(a)

There is appropriated fifty thousand dollars ($50,000.00) from the general fund to the legislative service office for the period beginning with the effective date of this act and ending June 30, 2025 to be expended only on salary, per diem and mileage for legislative members of the task force on state lands and investments for attendance at meetings of the task force. This appropriation shall not be transferred or expended for any other purpose and any unexpended, unobligated funds remaining from this appropriation shall revert as provided by law on June 30, 2025.

(b)

There is appropriated twenty
‑
five thousand dollars ($25,000.00) from the general fund to the office of the governor for the period beginning with the effective date of this act and ending June 30, 2025 to be expended only on per diem and mileage for the three (3) nonvoting, ex officio members appointed by the governor to the task force on state lands and investments for attendance at meetings of the task force. This appropriation shall not be transferred or expended for any other purpose and any unexpended, unobligated funds remaining from this appropriation shall revert as provided by law on June 30, 2025.

Section 3
.

This act is effective immediately upon completion of all acts necessary for a bill to become law as provided by Article 4, Section 8 of the Wyoming Constitution.
