Be It Enacted by the Legislature of the State of Wyoming:

Capitol complex child care facility.
(a)
As used in this section:
(i)
"Capitol complex" means as defined by W.S. 9

101(e)(i);
(ii)
"Certified child care facility" means a child caring facility certified pursuant to W.S. 14

(iii)
"State employees" means employees of the executive branch, the judiciary and the legislature.
(b)
The department shall facilitate the establishment and operation of a certified child care facility within the capitol complex for state employees in accordance with this section. To the extent necessary, the department shall exercise its authority to plan for agency office and other space needs under W.S. 9

3204(b)(xxiii) to provide space within the capitol complex for the certified child caring facility.
(c)
The certified childcare facility under this section shall:
(i)
Be operated by the general services division of the department; or
(ii)
If it is determined more cost efficient by the director of the department, the department may contract for the provision of certified child care services at the facility.
(d)
Subject to the availability of capacity, children from families in which at least one (1) parent or guardian is a state employee shall be eligible to receive the child care services at the certified child care facility provided for under this section. The child care services shall be provided at no cost to the state employee.
(e)
The department shall adopt rules governing the
operation, capacity and use of the certified child care facility under this section.

The general services division shall:

Establish and operate or contract for the operation of a certified child care facility in accordance with W.S. 9

Section 3.
It is the intent of the legislature that the department of administration and information submit an exception budget request for the fiscal biennium commencing July 1, 2024 and ending June 30, 2026 for the establishment and operation of a certified child care facility pursuant to W.S. 9

3222, as created by this act. The request may include funding for full-time, part-time and at-will employee positions, contract certified child care provider costs, building improvements, supplies and other costs necessary to carry out the requirements of W.S. 9

3222, as created by this act.
Section 4.
This act is effective July 1, 2023
