AN ACT relating to game and fish; allowing for the game and fish commission to designate official nonprofit partners as specified; providing requirements and obligations for official nonprofit partners; requiring rulemaking; and providing for an effective date.

Official nonprofit partners; requirements; limitations; liability.

(a)

With the consent of the corporation, the commission may designate one (1) or more corporations exempt from taxation pursuant to section 501(c)(3) of the Internal Revenue Code as an official nonprofit partner. The board of directors of any official nonprofit partner designated under this subsection shall include one (1) member of the commission and the director of the department as nonvoting members.

(b)

Any official nonprofit partner designated under this section shall:

(i)

Be dedicated to fundraising and supporting the priorities and objectives of the department;

(ii)

Be dedicated to projects and initiatives consistent with the priorities and objectives of the department;

(iii)

Provide an annual report showing the identity of all donors and the amount each person or entity donated as well as all expenditures or other disposal of money donated.

(c)

Any official nonprofit partner designated under this section may:

(i)

Accept gifts, grants and donations to further the department's objectives, including gifts, grants or donations made in the name of the department;

(ii)

Organize and manage accounts for local nonprofit partners or other organizations to benefit a specific department project or initiative;

(iii)

Create and fund positions and execute contracts to accomplish department projects or initiatives. No public funds shall be expended for this purpose.

(d)

The department shall not be liable for any acts or omissions of any official nonprofit partner. No debts, bonds, notes or other obligations incurred by any official nonprofit partner shall constitute an indebtedness or obligation of the state of Wyoming nor shall any act of any official nonprofit partner constitute or result in the creation of an indebtedness of the state.

(e)

The commission shall not designate any corporation as an official nonprofit partner that is unable to meet all the obligations and requirements of subsection (b) of this section.

(f)

The commission shall promulgate any rules and regulations necessary consistent with the requirements of this section.

As used in this act:

Section 3.

The game and fish commission shall promulgate any rules necessary to implement this act.

This act is effective immediately upon completion of all acts necessary for a bill to become law as provided by Article 4, Section 8 of the Wyoming Constitution.
