AN ACT relating to crimes and offenses; creating the offense of breach of the peace within a health care facility; providing penalties; providing a definition; and providing for an effective date.

Be It Enacted by the Legislature of the State of Wyoming:

Breach of the peace; breach of the peace within a health care facility; penalties.

(c)

A person commits breach of the peace within a health care facility if he disturbs the peace of a health care facility or its occupants by unreasonably loud noise or music or by using threatening, abusive or obscene language or violent actions with knowledge or probable cause to believe he will disturb the peace.

(d)

Breach of the peace within a health care facility is a misdemeanor punishable by imprisonment for not less than one (1) day nor more than ninety (90) days, a fine of not more than seven hundred fifty dollars ($750.00), or both.

(e)

As used in subsections (c) and (d) of this section, "health care facility" means as defined in W.S. 35

901(a)(x) and shall include the office or facility of a licensed doctor of medicine, chiropractor, osteopath, dentist, optometrist, podiatrist, psychologist, physician's assistant or advanced practitioner of nursing.
