A BILL

for

AN ACT relating to the administration of government; providing an appropriation for purposes of grants for school crosswalk improvement and pedestrian bridge planning, design and construction; specifying conditions for grants; and providing for an effective date.

Be It Enacted by the Legislature of the State of Wyoming:

Section 1
.

(a)

There is appropriated ten million dollars ($10,000,000.00) from the general fund to the Wyoming department of transportation for the period beginning with the effective date of this act and ending June 30, 2028 to be expended only for purposes of providing funds for school crosswalk projects on state highways and for school crosswalk projects on roadways of cities, towns and counties in accordance with subsection (b) of this section and for administrative expenses in accordance with subsection (c) of this section. This appropriation shall not be transferred or expended for any other purpose and any unexpended, unobligated funds remaining from this appropriation shall revert as provided by law on June 30, 2028. It is the intent of the legislature that this appropriation not be included in the standard budget of the department of transportation for any immediately succeeding fiscal biennium.

(b)

The department of transportation shall expend or distribute funds appropriated under subsection (a) of this section to cities, towns, counties, agencies, political subdivisions and any other entity of the state in accordance with the following:

(i)

Funds shall only be expended by the department, cities, towns, counties, agencies, political subdivisions and any other entity of the state on improvements to crosswalks identified in a local transportation plan that support safe routes to school or that are located within school zones where the speed limit is reduced in accordance with W.S. 31-5-301(b)(i) or where the crosswalk is immediately adjacent to a school facility. For purposes of this paragraph, improvements to crosswalks shall include:

(A)

Planning, design, construction and installation of pedestrian overpasses;

(B)

Planning, design, construction and installation of pedestrian underpasses or tunnels;

(C)

Improvements to existing school crosswalks, including improvements to existing pedestrian overpasses, pedestrian underpasses, signage, signals, lighting and the roadway adjacent to school crosswalks.

(ii)

The department shall prioritize the expenditure and distribution of funds for school crosswalks in the following order:

(A)

School crosswalks where a fatality has occurred within the last two (2) years;

(B)

School crosswalks where an injury or other accident has occurred within the last two (2) years;

(C)

Any other school crosswalk where the department determines that there is a need for an improvement specified in paragraph (i) of this subsection;

(D)

Any school crosswalk identified in a local transportation plan.

(iii)

Before allowing expenditure of the funds appropriated under this section, the department shall require any city, town, county, agency, political subdivision or any other entity of the state participating in the grant program to provide not less than a twenty-five percent (25%) match of any funds to be expended;

(iv)

Projects for school crosswalks shall be completed not later than June 30, 2028.

(c)

The distribution of funds appropriated under this act shall be in the same manner as the department currently administers the transportation alternatives program.

Section 2
.

This act is effective immediately upon completion of all acts necessary for a bill to become law as provided by Article 4, Section 8 of the Wyoming Constitution.
