AN ACT relating to public utilities; requiring customer allocation agreements for utility service to a customer in the certificated territory of another utility; authorizing a civil action and recovery for violations; requiring rulemaking; and providing for an effective date.

Certificate of convenience and necessity; hearings.

(k)

No public utility shall provide service directly or indirectly to a customer in another public utility's certificated service territory, including by providing service to a point of delivery outside of the other public utility's certificated territory for consumption within the other public utility's certificated territory, without a customer allocation agreement between the customer and both public utilities. Any violation of this subsection shall entitle the aggrieved public utility to recover in a civil action damages for lost income from the unlawful invasion of its certificated service territory, plus all attorney fees and expenses incurred by the aggrieved public utility that enforces its rights under this subsection in a civil action.
