Be It Enacted by the Legislature of the State of Wyoming:

Section 1.

Maximum payment.

(a)

Except as provided by W.S. 27
‑
3
‑
316, the maximum amount of benefits payable to any eligible individual in a benefit year shall not exceed
twenty
‑
six (26) times his weekly benefit or
the lesser of:

(i)

T
hirty percent (30%) of his wages payable for insured work in his base period
;
, whichever is less. This

or

(ii)

For claims submitted during a calendar year, an amount determined by multiplying the weekly benefit of the individual by the following number of weeks:

(A)

Twelve (12) weeks if the state's average unemployment rate is five percent (5%) or less;

(B)

Twelve (12) weeks plus an additional week for every one
‑
half of one percent (0.5%) that that the state's average unemployment rate is above five percent (5%);

(C)

A maximum of twenty
‑
three (23) weeks if the state's average unemployment rate equals or exceeds ten and one
‑
half percent (10.5%).

(b)

The
amount
calculated under this section
shall be computed to the next higher multiple of

the individual's
weekly benefit.

(c)

As used in this section, "state's average unemployment rate" means the most recent average of the seasonally adjusted statewide unemployment rates published by the department of workforce services for the third quarter which shall be the months of July, August and September.

Section 2.

This act shall only apply to unemployment claims filed on or after July 1, 2023.
