Be It Enacted by the Legislature of the State of Wyoming:

(a)

As used in this section:

(i)

"Child custody determination" means as defined by W.S. 20

202(a)(iii);

(ii)

"Physical custody" means as defined by W.S. 20
‑
5
‑
202(a)(xiv).

(b)

A person who has been granted physical custody or visitation with a child pursuant to a child custody determination is guilty of interference with parent
‑
child contact if the person willfully prevents or obstructs the rights of another person entitled to physical custody or visitation with the child pursuant to a child custody determination.

(c)

It is an affirmative defense to a prosecution under this section that:

(i)

The action was necessary to preserve the child from an immediate danger to his welfare; or

(ii)

The child was not less than fourteen (14) years old and the child was taken away or was not returned:

(A)

At his own instigation; and

(B)

Without intent to commit a criminal offense with or against the child.

Interference with parent

child contact is a misdemeanor punishable by imprisonment for not more than six (6) months, a fine of not more than seven hundred fifty dollars ($750.00), or both.
