AN ACT relating to the insurance code; requiring health care providers to be responsible for tendering insurance claims to health insurance companies as specified; prohibiting terms between a health care provider and a patient that require the patient to tender the insurance claim; providing applicability; and providing for an effective date.

Be It Enacted by the Legislature of the State of Wyoming:

136 by creating a new subsection (c) is amended to read:

Assignment of insurance proceeds to doctor, hospital or state agency; lien for state care; notice of lien.

(c)

In any accepted assignment of benefits under subsections (a) or (b) of this section, the assignee shall have the responsibility to submit the claim for benefits due under the contract to the relevant third party agency or insurer. If an assignee accepts an assignment of benefits, the assignee shall not require the beneficiary to be responsible for submitting the claim to the relevant third party agency or insurer. In the event an assignee fails to submit the claim in a timely or complete manner, the risk of nonpayment shall be borne by the assignee and the assignee shall have no recourse against the beneficiary, applicant or recipient.

Section 2.

This act applies to assignments of benefits initiated on or after July 1, 2024.

Section 3.

This act is effective July 1, 2024
