Abandoned mine land grant program.

(a)

The governor, through the director or administrator of the abandoned mine land division shall establish a grant program so that a local government entity may apply for a grant of any abandoned mine land funds as provided under this section on forms prescribed by the director or the administrator of the abandoned mine land division. Grants may be applied for by a joint powers board with the approval of all participating agencies to the joint powers agreement. The priority of the award of all grants of abandoned mine land funds for projects requested by local government entities under this section shall be determined in accordance with applicable federal law and the provisions of this article by the governor, through the director or administrator of the abandoned mine land division.

(b)

The governor shall consult with the director, the administrator of the abandoned mine land division and the United States department of interior, office of surface mining reclamation and enforcement as necessary to administer the grant program under this section.

The governor may promulgate rules as necessary to administer the grant program under this section as provided by W.S. 35

1207(a).

(c)

Each complete application for grants under this section that conform with the criteria established by law and rules promulgated under this section shall be considered and approved or disapproved within one hundred twenty (120) days of receipt of a complete application in accordance with this section.

(d)

Any grant approved under this section and further approved by the United States department of interior, office of surface mining reclamation and enforcement shall have priority over any other projects approved under this article.

(e)

On or before November 1 of each year, the administrator of the abandoned mine land division shall report to the joint appropriations committee on the administration of the grant program under this section. The report shall include a list of all grant requests and grant approvals made in the previous twenty

four (24) months.

Section 2.

The governor shall adopt any rules necessary to implement this act not later than July 1, 2024.

(a)

Except as provided in subsection (b) of this section, this act is effective immediately upon completion of all acts necessary for a bill to become law as provided by Article 4, Section 8 of the Wyoming Constitution.
