AN ACT relating to public funds; prohibiting the expenditure of funds for any products or services that use child labor or slave labor as specified; providing definitions; making conforming amendments; requiring rulemaking; specifying applicability;

and providing for effective dates.

Public funds; prohibitions on use associated with child labor and slave labor.

(a)

As used in this section:

(i)

"Child labor" means any work or service that is:

(A)

Exacted from or performed by any person under the age of eighteen (18) years in violation of federal or state law governing labor and employment performed by persons under eighteen (18) years of age; or

(B)

Exacted from or performed by any person under the age of eighteen (18) years in any country other than the United States that would violate United States federal or state law governing labor and employment performed by persons under eighteen (18) years of age.

(ii)

"Slave labor" means any work or service that is exacted from any person in or outside of the United States under threat or menace of penalty for any nonperformance and for which the person does not offer himself voluntarily.

(b)

Except as provided in subsection (c) of this section, no agency, entity or recipient of any funds from an agency or entity shall use any Wyoming general funds, Wyoming other funds or federal funds that are appropriated, authorized or otherwise available for expenditure shall use those funds for:

(i)

Any service that uses child labor or slave labor;

(ii)

Any product for which child labor or slave labor is used to make, prepare or produce the product.

(c)

This section shall not apply to any labor or work performed under:

(i)

The Juvenile Justice Act or the Children in Need of Supervision Act;

(ii)

The correctional industries program in W.S. 25

(iii)

Title 7, chapter 16 of the Wyoming statutes.

(d)

The department shall promulgate all rules necessary to ensure compliance with the requirements of this section.

As used in this act:

Section 3.

(a)

This act shall apply to:

(i)

Any appropriation, authorization for expenditure or expenditure that takes effect on or after the effective date of this act;

(ii)

Any appropriation, authorization for expenditure or expenditure that is made on or after the effective date of this act.

(b)

Nothing in this act shall be construed to alter or impair any contract or agreement entered into before the effective date of this act.

Section 4.

The state budget department shall promulgate all rules necessary to implement this act.

Except as provided in subsection (b) of this section, this act is effective July 1, 2024
.

(b)

Sections 4 and 5 of this act are effective immediately upon completion of all acts necessary for a bill to become law as provided by Article 4, Section 8 of the Wyoming Constitution.
