A BILL

for

AN ACT relating to state lands; requiring a study on the feasibility of an access point permitting system for commercial fishing activities; requiring a report; requiring the joint travel, recreation, wildlife and cultural resources interim committee to review the report and sponsor legislation as necessary; and providing for an effective date.

Be It Enacted by the Legislature of the State of Wyoming:

Section 1
.

(a)

Not later than October 1, 2024, the office of state lands and investments shall complete a study on the feasibility of establishing an access point permitting program for commercial fishing activities on state lands in Wyoming. As part of this study, the department shall consider the following:

(i)

The potential benefit to Wyoming residents and to the state land trust beneficiaries from the implementation of an access point permitting program;

(ii)

Any administrative costs, impacts and savings to the office of state lands and investments associated with the implementation and supervision of an access point permitting program in Wyoming, including the need for additional personnel to implement and operate the program;

(iii)

Any funding, spending or borrowing authorization

necessary to maintain a month to month cash flow of funds necessary for administering an access point permitting program;

(iv)

The number of current access points located on state lands, the number of commercial fishing outfitters currently using these access points on state lands, the potential for the construction of new access points and the ability for outfitters engaging in commercial fishing activities to reach those access points;

(v)

A review of other states that have implemented access point permitting programs for commercial fishing activity and whether those programs were successfully implemented and maintained;

(vi)

A review of other agencies, both state and federal, that have implemented access point permitting programs for commercial fishing activity and whether those programs were successfully implemented and maintained;

(vii)

Whether agreements with other state or federal agencies would be necessary in the implementation of the access point permitting program;

(viii)

The comparative costs for similar permitting programs from other states and federal agencies in consideration of the creation of an access point permitting program;

(ix)

The ability to enforce the access point permitting program;

(x)

What, if any, rules or regulation would be necessary to implement and operate the access point permitting program.

(b)

Not later than October 1, 2024, the office of state lands and investments shall report to the joint travel, recreation, wildlife and cultural resources interim committee on the results of the study required by subsection (a) of this section. As part of this report, the office of state lands and investments shall recommend whether it is feasible to implement an access point permitting program for commercial fishing activity on state lands in Wyoming, including recommendations for legislation to authorize a program, if necessary.

(c)

The joint travel, recreation, wildlife and cultural resources interim committee may sponsor any legislation necessary to implement the recommendations the office of state lands makes as part of the study required under subsection (a) of this section.

Section 2.

This act is effective immediately upon completion of all acts necessary for a bill to become law as provided by Article 4, Section 8 of the Wyoming Constitution.
