AN ACT for a legislative order to prohibit enforcement of department of education rules on career and technical education program grants as specified; providing legislative findings; specifying applicability; and providing for an effective date.

Be It Enacted by the Legislature of the State of Wyoming:

Section 1
.

Legislative findings.

(a)

The legislature finds that section 2(a) of chapter 36 of the rules promulgated by the department of education relating to career and technical education program grants, filed with the secretary of state on October 18, 2023 and signed by the governor on November 29, 2023, does not properly implement legislative intent and is not within the scope of legislative authority. Specifically, the rules specify a maximum grant amount of two hundred thousand dollars ($200,000.00) in any two year period, however W.S. 21

105 authorizes a maximum grant amount of three hundred fifty thousand dollars ($350,000.00) in any two year period. The agency determining a different maximum amount by rule does not implement legislative intent and is not within the scope of legislative authority.

(b)

The legislature further finds that the implementation and enforcement of the rules specified in subsection (a) of this section should be prohibited pursuant to W.S. 28

Section 2.

Legislative Order.

(a)

It is ordered by the legislature, each house voting separately, that implementation and enforcement of the rules specified in section 1, subsection (a) of this order are prohibited and that the rules are null and void.

(b)

The secretary of state is directed to make appropriate entries on the specified rules of the department of education on file in the official registry of administrative rules and regulations to indicate that the rules referenced in this order are void and unenforceable as provided in W.S. 28

Section 3.

Nothing in this legislative order shall be deemed to affect any career and technical education program grants issued under the rules prior to the effective date of this act.

Section 4
.

This act is effective immediately upon completion of all acts necessary for a bill to become law as provided by Article 4, Section 8 of the Wyoming Constitution.
