Be It Enacted by the Legislature of the State of Wyoming:

(m)

The commission shall establish the number of actual live horse racing or pari
‑
mutuel event days required to qualify for a simulcasting permit.
A live horse racing day shall consist of not less than six (6) races with not less than six (6) horses per race.
The commission shall adopt rules governing establishment of live horse racing or pari
‑
mutuel event days required for a simulcasting permit in a manner that ensures fair and equitable involvement of all affected parties, including consideration of the economic viability of those days to permit applicants.
For pari
‑
mutuel wagering on events that have previously occurred, the simulcasting permit shall be limited as follows:

(i)

No permit shall be issued for a location that will have less than twenty (20) electronic devices for pari
‑
mutuel wagering;

(ii)

The permit shall be limited to not more than fifty (50) electronic devices for pari
‑
mutuel wagering for each day of live horse racing days required to qualify for a simulcasting permit under this subsection. If the number of live horse racing days required to qualify for a simulcasting permit under this subsection is not met in any calendar year, in the following calendar year the permit holder shall reduce the number of electronic devices utilized by the permit holder by fifty (50) for each day of live horse racing in the preceding calendar year that was less than the number of live horse racing days required to qualify for a simulcasting permit under this subsection.
