A JOINT RESOLUTION

for

A JOINT RESOLUTION in support of meaningful state and local government involvement in drafting proposed federal rules, resource management plans and environmental impact statements.

WHEREAS, Congress grants rulemaking authority to federal agencies; and

WHEREAS, the National Environmental Policy Act requires federal agencies to prepare environmental impact statements if a proposed major federal action is determined to significantly affect the quality of the environment; and

WHEREAS, the Federal Land Policy and Management Act requires the Bureau of Land Management (BLM) to develop land use plans, including resource management plans, and seek cooperating state and local government input to manage the public lands and resources in accordance with principles of multiple use and sustained yield; and

WHEREAS, the BLM has proposed the following rules: Conservation and Landscape Health 88 Fed. Reg. 19583 and Fluid Mineral Leases and Leasing Process 88 Fed. Reg. 47562; and

WHEREAS, the BLM has proposed a draft resource management plan and environmental impact statement for the Rock Springs planning area covering surface land and mineral estate in portions of Lincoln, Sweetwater, Uinta, Sublette and Fremont counties in southwestern Wyoming; and

WHEREAS, the BLM may propose future resource management plans and environmental impact statements that negatively affect Wyoming; and

WHEREAS, the United States Department of Agriculture has proposed the Land Management Plan Direction for Old Growth Forest Conditions Across the National Forest System rule 88 Fed. Reg. 88042; and

WHEREAS, the New York Stock Exchange (NYSE) had filed with the United States Securities and Exchange Commission a proposed rule to amend the NYSE manual to adopt listing standards for natural asset companies 88 Fed. Reg. 68811; and

WHEREAS, these aforementioned or other rules, resource management plans and environmental impact statements negatively affect Wyoming including Wyoming's agriculture, energy, mineral and recreation industries.

NOW, THEREFORE, BE IT RESOLVED BY THE MEMBERS OF THE LEGISLATURE OF THE STATE OF WYOMING:

Section 1.

That the members of the Wyoming Legislature support meaningful state and local government involvement in drafting and developing proposed federal rules, resource management plans and environmental impact statements.

Section 2.

That the members of the Wyoming Legislature commit to oppose the aforementioned or similar proposed federal rules, resource management plans and environmental impact statements that negatively affect Wyoming including Wyoming's agriculture, energy, mineral and recreation industries, particularly the BLM's preferred alternative, Alternative B, in the draft Rock Springs resource management plan and environmental impact statement.

Section 3.

That the members of the Wyoming Legislature commit to oppose the aforementioned or similar proposed federal rules, resource management plans and environmental impact statements because they do not respect the custom and culture of Wyoming.

Section 4.

That the Secretary of State of Wyoming transmit copies of this resolution to the director of the bureau of land management, the director of the department of the interior, the secretary of the United States department of agriculture, the chairman of the securities and exchange commission, the President of the United States, to the President of the Senate and the Speaker of the House of Representatives of the United States Congress and to the Wyoming Congressional Delegation.
