A JOINT RESOLUTION

for

A JOINT RESOLUTION providing for a prohibition on the imposition of a carbon tax by the state and any political subdivision or local governmental entity.

BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF WYOMING,
two-thirds of all the members of the two houses, voting separately, concurring therein:

Section 1.

The following proposal to amend the Wyoming Constitution, Article 15 by creating a new section 21 is proposed for submission to the electors of the State of Wyoming at the next general election for approval or rejection to become valid as a part of the Constitution if ratified by a majority of the electors at the election:

Article 15, Section 21. Carbon tax prohibited.

(a)

As used in this section, "carbon tax" means any tax that is a tax, fee, assessment or penalty on:

(i)

The use or purchase of carbon or carbon
‑
based products based on the carbon content of the product or the amount of carbon used or emitted to produce the product;

(ii)

The use or purchase of electricity or other utilities based on the carbon usage, carbon emissions or carbon content of fuel used to produce the electricity or the other utility that is used or purchased; or

(iii)

The carbon content of fuels or electricity used or consumed.

(b) Neither the state nor any county, city, town or other political subdivision shall impose, levy or collect any carbon tax.

Section 2.

That the Secretary of State shall endorse the following statement on the proposed amendment:

The adoption of this amendment would prohibit the state and each county, city, town, political subdivision and any other governmental entity from imposing a carbon tax, which is a tax based on the carbon usage or content of the product or service provided.
