Military department emergency fire suppression account; creation; investment of funds; authorized expenditures; rulemaking.

(a)

As used in this section, "emergency fire" means a fire burning on or originating on any state lands managed by the military department that is or clearly threatens to be, beyond the fire control resources of the military department.

(b)

There is created the military department emergency fire suppression account. The account shall include all legislative appropriations and all funds deposited to the account by the military department. The military department may accept funds including donations, gifts, bequests, devises and grants for the account and shall deposit any received funds in the account. Notwithstanding W.S. 9

207, unobligated and unexpended funds in the account shall not lapse or revert and shall remain available for distribution as provided in this section.

(c)

Any unexpended balance in the account shall be invested by the state treasurer and the investment earnings shall be credited to the general fund.

(d)

Funds appropriated by the legislature for emergency fire suppression on state lands managed by the military department shall be deposited into the account. All funds in the account are continuously appropriated for contracts and other expenses authorized under this section.

(e)

Upon written approval of the adjutant general, expenditures shall be made out of the account for the actual costs of suppressing emergency fires on state lands managed by the military department.

(f)

If the adjutant general determines that monies in the account may be insufficient to fully reimburse the costs of suppressing all emergency fires occurring or which may occur during the year, the adjutant general may delay paying reimbursement to any entity until the close of the program year at which time available monies shall be prorated among those entities entitled to reimbursement.

Section 2.

The military department shall promulgate all rules necessary to implement this act.

Section 3.

There is appropriated two million dollars ($2,000,000.00) from the general fund to the military department emergency fire suppression account created in Section 1 of this act. This appropriation shall be for the period beginning with the effective date of this act. This appropriation shall not be transferred or expended for any other purpose. Notwithstanding W.S. 9
