Plain English Breakdown
The bill summary and text do not provide information on enforcement mechanisms for violations.
Ban on Unsolicited Absentee Ballot Request Forms
This law stops people from sending unsolicited absentee ballot request forms to voters, except for county clerks and the secretary of state.
What This Bill Does
Prohibits anyone but a county clerk, the secretary of state or their designees from distributing unsolicited absentee ballot request forms to qualified electors.
Defines an 'absentee ballot request form' as any document that claims to be or is deceptively similar to an official election document and provided by mail, email, or other means.
Who It Names or Affects
Voters who receive unsolicited absentee ballot request forms will no longer get them unless they ask for one.
County clerks and the secretary of state can still send out absentee ballot request forms to voters.
Terms To Know
Qualified elector
A person who is registered to vote in an election.
Limits and Unknowns
The law does not specify the consequences for violating this prohibition.
It is unclear how strictly 'deceptively similar' will be enforced.
Amendments
These notes stay tied to the official amendment files and metadata from the legislature.
Plain English: The amendment changes part of a bill to add new rules about who can send unsolicited absentee ballot request forms.
Adds a new section (e) that says no one except county clerks or the secretary of state can distribute unsolicited absentee ballot request forms by mail, email, or any other method.
The amendment text does not specify what happens if someone violates this rule, so it's unclear what consequences there might be for breaking these new restrictions.
Standing Committee • Senate Corporations, Elections & Political Subdivi
Adopted
Plain English: The amendment changes the wording of the bill's catch title to specify that unsolicited absentee ballot request forms, rather than general ballot forms, are prohibited from being distributed.
Changes 'Prohibition on' in the catch title to remove it and clarify the focus.
Replaces 'ballot forms' with 'absentee ballot request forms' to specify exactly what is prohibited.
