Prohibited private party sales and transfers of real property to federal government; exception; civil penalty.

(a)

As used in this section:

(i)

"Federal government" means the United States or any agency or instrumentality thereof;

(ii)

"Real property" means all interests in real property, including but not limited to, the fee estate, leasehold interests, easements, rights

way, subsurface interests, airspace interests, water rights and mineral interests.

(b)

No person shall sell or transfer real property in this state to the federal government unless the person acquires consent from the Wyoming legislature.

(c)

To acquire consent from the Wyoming legislature as required by subsection (b) of this section, a person selling or transferring real property in this state to the federal government shall submit to the legislative service office before a legally binding agreement is entered into by the person and the federal government:

(i)

A notice of intent to sell or transfer the real property in this state to the federal government; and

(ii)

Evidence that the federal government would be acquiring the real property in this state pursuant to an enumerated constitutional power which may involve the exercise of the federal power of eminent domain.

(d)

If a person fails to submit the information required by subsection (c) of this section before a legally binding agreement is entered into by the person and the federal government to sell or transfer real property in this state to the federal government, the person shall be liable for a civil penalty in an amount equal to the net proceeds received from the sale or transfer of the real property.

(e)

For purposes of acquiring consent from the Wyoming legislature as required by subsection (b) of this section, the Wyoming legislature during regular or special session may approve or reject a notice of intent to sell or transfer the real property to the federal government by legislative order. When the legislature is not in regular or special session, the management council shall have the right to approve or reject a notice of intent to sell or transfer the real property to the federal government by a majority vote. The legislature or the management council shall not approve a notice of intent to sell or transfer real property to the federal government unless the federal government would be acquiring the real property pursuant to an enumerated constitutional power which may involve the exercise of the federal power of eminent domain. The legislature or the management council shall approve or reject the notice of intent to sell or transfer the real property under this subsection not later than ten (10) days after receipt of the notice. If the legislature or management council does not approve or reject notice of intent to sell or transfer the real property within ten (10) days after receipt of the notice then the notice for the sale to proceed is deemed rejected.

Section 2.

The legislature and the management council shall adopt all rules and policies necessary to implement this act.

Section 3.

This act shall apply to notices of intent to sell or transfer real property to the federal government entered into on and after July 1, 2025.
