A JOINT RESOLUTION

for

A JOINT RESOLUTION providing that, for purposes of determining whether a person is a qualified elector, the person shall not be deemed to be a United States citizen if the person also possesses citizenship of a foreign adversary of the United States.

BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF WYOMING,
two-thirds of all the members of the two houses, voting separately, concurring therein:

Section 1.

The following proposal to amend Wyoming Constitution, Article 6, Section 5 is proposed for submission to the electors of the State of Wyoming at the next general election for approval or rejection to become valid as a part of the Constitution if ratified by a majority of the electors at the election:

Article 6, Section 5.

Electors must be citizens of United States and not a foreign adversary; sole citizenship in the United States required for elected office.

(a)

No person shall be deemed a qualified elector of this state, unless such person be a citizen of the United States.

(b)

For purposes of this section, no person shall be deemed to be a citizen of the United States if the person simultaneously possesses citizenship in any country that has been declared a foreign adversary of the United States. If a person is a citizen of the United States and also possesses citizenship in a foreign adversary of the United States, to be a qualified elector the person shall submit to the secretary of state a written renunciation of foreign citizenship with any foreign adversary of the United States. If any person who is seeking an elected office or who holds an elected office in the state of Wyoming voluntarily acquires citizenship in a foreign adversary of the United States, the person shall be deemed to have relinquished United States citizenship for purposes of determining whether the person is qualified to vote or to hold the elected office. The legislature shall determine by counties that are foreign adversaries of the United States.

Section 2.

That the Secretary of State shall endorse the following statement on the proposed amendment:

The adoption of this amendment would specify that, for purposes of qualification to vote or to hold any elected office in the state of Wyoming, no person shall be deemed to be a citizen of the United States if the person simultaneously possesses citizenship in a foreign adversary of the United States. The amendment would provide a process for a person to renounce foreign citizenship and would also specify that any person who voluntarily acquires citizenship in a foreign adversary while seeking election or while holding an elected office would be deemed to have relinquished United States citizenship for purposes of determining whether the person is qualified for the elected office.
