Summary/Major Elements: The bill allows public works contracts to be let using construction managers or contract managers at risk. The bill defines construction manager as a type of construction delivery method where the manager acts as a consultant providing administrative and management service throughout the design and construction phases of a project. The bill defines construction manager at risk as a type of construction delivery method where the manager acts as an advocate for the public entity throughout the pre-construction phase of a project. During the construction phase the manager is responsible for all project subcontracts and purchase orders. The contract manager at risk is responsible for finishing the project within a guaranteed maximum price.
