Subject: Adopting the uniform law on notarial acts. Summary/Major Elements: This act: Creates the Wyoming Uniform Law on Notarial Acts by adopting the Uniform Law on Notarial Acts; Establishes who can take "notarial acts" in Wyoming; Guides a notarial officer's process for taking acknowledgments, taking verifications upon oath or affirmation, witnessing or attesting a signature, certifying or attesting a copy, certifying an instrument executed by a business, certifying instruments executed by a trustee, testamentary trust or express trust and for making or noting the protest of a negotiable instrument; Sets standards for recognizing notarial acts taken outside of Wyoming; Establishes standards for establishing a person's identity; and Defines the contents of a notarial certificate. Provides sample certificate forms for various types of notarial acts. Exempts from coverage notarial acts taken before its effective date. Amends the existing statutes by specifying the officers who can administer oaths, but who cannot take other notarial acts. Repeals Wyoming's Acknowledgement Act. Repeals W.S. 34-1-126 which imposed a fine on county clerks for recording improperly notarized documents.
