Official summary

2008 General Session Summary for SF0083 Bill No.: SF0083 Drafter: DRN LSO No.: 08LSO-0101 Effective Date: Enrolled Act No.: SEA0037 Chapter No.: Prime Sponsor: Senator Job Catch Title: Retirement-rehired retirees. Subject: Re-employment after retirement under the Wyoming retirement system. Summary/Major Elements: 2007 Laws, Chapter 78 allowed the hiring of state retirees following a thirty day break in service if a fee was paid to the retirement system equal to the required retirement contribution for that rehired position (provided employer flexibility to hire needed positions and at the same time, eliminated actuarial concerns expressed by the retirement system); This act limits the type of position covered under this rehire provision by requiring the filled position to be a "full-time" position of a regular contributing employee. This enables a retiree to be employed as a substitute teacher or to take a part-time position without forcing the employer to pay the contribution fee.

Why lawmakers voted

Voted Yes

Why they voted this way

The lawmaker explains that previous legislation unintentionally included substitute teachers, causing administrative issues. This bill clarifies the rules to exclude substitutes and ensures employers only pay retirement contributions for normally contributing positions.
