A BILL FOR AN ACT relating to postsecondary education; to amend section1
85-906, Revised Statutes Supplement, 2025; to redefine terms2
regarding reportable funding from a foreign adversarial source; and3
to repeal the original section. 4

Section 1. Section 85-906, Revised Statutes Supplement, 2025, is1
amended to read: 2
85-906 (1) For purposes of this section: 3
(a) Contract means any agreement between a covered institution and a4
foreign adversarial source for the acquisition by purchase, lease, or5
barter of property or services, for the direct benefit or use of the6
foreign adversarial source either of the parties; 7
(b) Covered institution means any public or private two-year or8
four-year college or university having a campus or place of business in9
Nebraska; 10
(c) Foreign adversarial source means: 11
(i) A foreign adversary government, including an agency of a foreign12
adversary government; 13
(ii) A legal entity, governmental or otherwise, created solely under14
laws of a foreign adversary government; 15
(iii) An individual who is a citizen or a national of a foreign16
adversary government; and 17
(iv) An agent of any entity or individual described in subdivision18
(1)(c)(i), (ii), or (iii) of this section, including a subsidiary or19
affiliate of a foreign adversary legal entity acting on behalf of any20
such entity or individual; 21
(d) Foreign adversary means a foreign adversary as determined22
pursuant to 15 C.F.R. 791.4, as such regulation existed on January 1,23
2025; and 24
(e) Reportable funding means revenue or the fair-market value of25
anything received as the result of any contract, gift, grant, endowment,26
award, scholarship, or donation, including a conditional or unconditional27
pledge of a contract, gift, grant, endowment, award, scholarship, or28
donation from a foreign adversarial source. Reportable funding does not29
include salary, wages, or compensation. 30
(2)(a) Except as provided in subdivision (b) of this subsection,31

each covered institution shall provide a report biannually to the1
Coordinating Commission for Postsecondary Education, in a manner2
prescribed by the commission, detailing all reportable funding received3
by the covered institution. Unless the information is exempt or4
prohibited from disclosure or deemed confidential under federal or state5
law, the report shall include the following information:6
(i) The amount of the reportable funding and the date that such7
funding was received; 8
(ii) A description of the type of reportable funding and the purpose9
for such funding, including whether the reportable funding is part of an10
ongoing relationship with the foreign adversarial source;11
(iii) A detailed description of the foreign adversarial source12
providing the reportable funding, including the name of the foreign13
adversarial source and, if not a foreign government, the country of14
citizenship, if known, and the country of principal residence or domicile15
of the foreign adversarial source; and 16
(iv) A copy of any contract, agreement, pledge, or memorandum of17
understanding associated with the funding. 18
(b) This section shall not require reporting of payments made to a19
covered institution by a natural person who would otherwise qualify as a20
foreign adversarial source for tuition or related fees to support an21
individual enrolled or planning to attend a covered institution.22
(c) The Coordinating Commission for Postsecondary Education shall23
post the report on its public website. 24
Sec. 2. Original section 85-906, Revised Statutes Supplement, 2025,25
is repealed. 26
