A BILL FOR AN ACT relating to legislation; to amend section 84-906.03,1
Reissue Revised Statutes of Nebraska; to require the Legislative2
Fiscal Analyst to prepare economic impact reports as prescribed; to3
require the Secretary of State to provide an annual report of rules4
and regulations; and to repeal the original section.5
Be it enacted by the people of the State of Nebraska,6

Section 1. (1) For purposes of this section, regulatory action1
means the adoption, promulgation, amendment, or withdrawal of a rule or2
regulation as defined in section 84-901. 3
(2) Along with a fiscal note, the Legislative Fiscal Analyst shall4
prepare and submit an economic impact report to the appropriate standing5
committee of the Legislature, for any legislative bill that would6
require, as the result of being signed into law, regulatory action by an7
agency as defined in section 84-901. 8
(3) The economic impact report shall include a cost benefit analysis9
including: 10
(a) The estimated primary or direct benefits;11
(b) The estimated cost savings or financial benefits to society;12
(c) The estimated number of businesses or other entities to which13
the regulatory action will apply; 14
(d) The identity of any localities and types of businesses or other15
entities that will be particularly affected by the regulatory action;16
(e) The estimated compliance costs for regulated entities, including17
costs for affected businesses, localities, or entities;18
(f) The estimated impact on the use and value of private property,19
including additional costs related to the development of real estate for20
commercial or residential purposes; 21
(g) The estimated effect on state expenditures, including estimated22
administrative expenses; 23
(h) The estimated secondary or indirect costs; and24
(i) Key assumptions and sources of uncertainty.25
(4) State agencies shall cooperate with the Legislative Fiscal26
Analyst by providing any information relevant to the economic impact27
report. 28
Sec. 2. Section 84-906.03, Reissue Revised Statutes of Nebraska, is29
amended to read: 30
84-906.03 It shall be the duty of the Secretary of State:31

(1) To establish and cause to be compiled, indexed by subject, and1
published a codification system for all rules and regulations filed to be2
designated the Nebraska Administrative Code; 3
(2) To cause the Nebraska Administrative Code to be computerized to4
facilitate agencies in revision of their rules and regulations and5
provide research capabilities; 6
(3) To post a current copy of existing rules and regulations as7
accepted by the Secretary of State as filed on the website of the8
Secretary of State; to distribute a current copy of any existing rules9
and regulations as accepted by the Secretary of State as filed to all10
interested persons on request at a price fixed to cover costs of11
printing, handling, and mailing; and to distribute, on a regular basis,12
copies of any or all modifications or amendments to agency rules and13
regulations as accepted by the Secretary of State as filed to all14
interested persons on request at a price fixed to cover costs of15
printing, handling, and mailing; and 16
(4) To remit fees collected pursuant to this section to the State17
Treasurer for credit to the Secretary of State Cash Fund; and .18
(5) To create and submit to the Clerk of the Legislature at the end19
of each calendar year, a report, indexed by agency, including the total20
number of new and amended rules and regulations adopted and promulgated21
that year. 22
Sec. 3. Original section 84-906.03, Reissue Revised Statutes of23
Nebraska, is repealed. 24
