A BILL FOR AN ACT relating to emergency medical services; to amend1
section 38-1201, Revised Statutes Cumulative Supplement, 2024; to2
provide billing requirements for emergency care providers as3
prescribed; to define a term; and to repeal the original section.4

Section 1. Section 38-1201, Revised Statutes Cumulative Supplement,1
2024, is amended to read: 2
38-1201 Sections 38-1201 to 38-1239 and section 2 of this act shall3
be known and may be cited as the Emergency Medical Services Practice Act.4
Sec. 2. (1) An emergency care provider shall not be eligible to5
receive state-funded emergency medical services grant assistance6
administered by the department unless such provider certifies, on a form7
prescribed by the department, that the provider maintains and implements8
a policy for billing for services by submitting claims to public or9
private third-party payors, if appropriate. 10
(2) For purposes of this section, billing for services means the11
regular submission of a claim for reimbursement to medicare, medicaid, a12
private health insurer, or a legally responsible third-party payor for13
emergency or non-emergency medical services provided by the emergency14
care provider. 15
Sec. 3. Original section 38-1201, Revised Statutes Cumulative16
Supplement, 2024, is repealed. 17
