A BILL FOR AN ACT relating to funds transfers; to amend section 71-7611,1
Revised Statutes Supplement, 2025; to provide for transfers of funds2
from the Nebraska Health Care Cash Fund to the Patient Safety Cash3
Fund; to harmonize provisions; to repeal the original section; and4
to declare an emergency. 5

Section 1. Section 71-7611, Revised Statutes Supplement, 2025, is1
amended to read: 2
71-7611 (1) The Nebraska Health Care Cash Fund is created. The State3
Treasurer shall transfer (a) sixty million three hundred thousand dollars4
on or before July 15, 2014, (b) sixty million three hundred fifty5
thousand dollars on or before July 15, 2015, (c) sixty million three6
hundred fifty thousand dollars on or before July 15, 2016, (d) sixty7
million seven hundred thousand dollars on or before July 15, 2017, (e)8
five hundred thousand dollars on or before May 15, 2018, (f) sixty-one9
million six hundred thousand dollars on or before July 15, 2018, (g)10
sixty-two million dollars on or before July 15, 2019, (h) sixty-one11
million four hundred fifty thousand dollars on or before July 15, 2020,12
(i) sixty-six million two hundred thousand dollars on or before July 15,13
2022, (j) fifty-six million seven hundred thousand dollars on or before14
July 15, 2023, (k) fifty-four million dollars on or before July 15, 2024,15
(l) fifty-nine million one hundred fifty thousand dollars on or before16
July 1, 2025, and (m) sixty million one hundred fifty thousand dollars on17
or before every July 15 thereafter from the Nebraska Medicaid18
Intergovernmental Trust Fund and the Nebraska Tobacco Settlement Trust19
Fund to the Nebraska Health Care Cash Fund, except that such amount shall20
be reduced by the amount of the unobligated balance in the Nebraska21
Health Care Cash Fund at the time the transfer is made. The state22
investment officer shall advise the State Treasurer on the amounts to be23
transferred first from the Nebraska Medicaid Intergovernmental Trust Fund24
until the fund balance is depleted and from the Nebraska Tobacco25
Settlement Trust Fund thereafter in order to sustain such transfers in26
perpetuity. The state investment officer shall report electronically to27
the Legislature on or before October 1 of every even-numbered year on the28
sustainability of such transfers. The Nebraska Health Care Cash Fund29
shall also include money received pursuant to section 77-2602. Except as30
otherwise provided by law, no more than the amounts specified in this31

subsection may be appropriated or transferred from the Nebraska Health1
Care Cash Fund in any fiscal year. 2
It Except as otherwise provided in subsections (5) and (6) of this3
section, it is the intent of the Legislature that no additional programs4
are funded through the Nebraska Health Care Cash Fund until funding for5
all programs with an appropriation from the fund during FY2012-13 are6
restored to their FY2012-13 levels. 7
(2) Any money in the Nebraska Health Care Cash Fund available for8
investment shall be invested by the state investment officer pursuant to9
the Nebraska Capital Expansion Act and the Nebraska State Funds10
Investment Act. 11
(3) The University of Nebraska and postsecondary educational12
institutions having colleges of medicine in Nebraska and their affiliated13
research hospitals in Nebraska, as a condition of receiving any funds14
appropriated or transferred from the Nebraska Health Care Cash Fund,15
shall not discriminate against any person on the basis of sexual16
orientation. 17
(4) The State Treasurer shall transfer fifteen million dollars from18
the Nebraska Health Care Cash Fund on or after July 1, 2022, but before19
June 30, 2023, to the Board of Regents of the University of Nebraska for20
the University of Nebraska Medical Center for pancreatic cancer research21
at the University of Nebraska Medical Center. Transfers from the Nebraska22
Health Care Cash Fund in this subsection shall be contingent upon receipt23
of any matching funds from private or other sources, up to fifteen24
million dollars, certified by the budget administrator of the budget25
division of the Department of Administrative Services. Upon receipt of26
any matching funds certified by the budget administrator, the State27
Treasurer shall transfer an equal amount of funds to the Board of Regents28
of the University of Nebraska. 29
(5) The State Treasurer shall transfer three hundred thousand30
dollars on or before July 15 of each fiscal year to the Patient Safety31

Sec. 2. Original section 71-7611, Revised Statutes Supplement,2
2025, is repealed. 3
Sec. 3. Since an emergency exists, this act takes effect when4
passed and approved according to law. 5
