A BILL FOR AN ACT relating to appropriations; to state intent regarding1
appropriations to the Department of Health and Human Services for2
medicaid nursing facility rates and related reports; and to declare3
an emergency. 4
Be it enacted by the people of the State of Nebraska,5

Section 1. It is the intent of the Legislature that the total1
amount appropriated to the Department of Health and Human Services, for2
medicaid nursing facility rates for Program No. 348, specified as3
$462,480,546 for FY2026-27 ($XXX General Funds and $XXX Federal Funds),4
shall be used in the medicaid nursing facility rate calculation for5
Program No. 348, including the calculation of the annual inflation6
factor. 7
It is the intent of the Legislature that the total amount8
appropriated for medicaid nursing facility rates for Program No. 3489
includes amounts for rate enhancement and any other purpose related to10
medicaid nursing facility services. 11
It is the intent of the Legislature that the department file a12
report electronically with the Legislative Fiscal Analyst and the Clerk13
of the Legislature no later than August 1, 2026, describing how the14
inflation factor was calculated for FY2026-27 medicaid nursing facility15
rates. 16
It is the intent of the Legislature that the department file a17
report electronically with the Legislative Fiscal Analyst and the Clerk18
of the Legislature on or after December 15, 2026, and before December 31,19
2026, identifying the amount of any remaining unobligated appropriation20
from the prior appropriations earmarked for medicaid nursing facility21
payments. The report shall include an identification of encumbrances and22
retroactive payments. 23
Sec. 2. Since an emergency exists, this act takes effect when24
passed and approved according to law. 25
