A BILL FOR AN ACT relating to the Convention Center Facility Financing1
Assistance Act; to amend section 13-2603, Revised Statutes2
Supplement, 2025; to redefine a term; and to repeal the original3

Section 1. Section 13-2603, Revised Statutes Supplement, 2025, is1
amended to read: 2
13-2603 For purposes of the Convention Center Facility Financing3
Assistance Act: 4
(1) Applicant means the political subdivision that applies for5
assistance under the act; 6
(2) Associated hotel means any publicly or privately owned facility7
in which the public may, for a consideration, obtain sleeping8
accommodations and which is located, in whole or in part, within six9
hundred yards of an eligible facility, measured from any point of the10
exterior perimeter of the eligible facility but not from any parking11
facility or other structure, except that if the eligible facility is12
within six hundred yards of the State Capitol, the area used in13
determining associated hotels shall be one or more contiguous or14
noncontiguous areas within the territorial boundaries of the applicant15
which are selected by the applicant and which aggregate the same total16
amount of square footage that such area would have contained had the17
eligible facility not been within six hundred yards of the State Capitol.18
The area used in determining associated hotels shall be depicted on a map19
submitted pursuant to section 13-2605; 20
(3) Board means a board consisting of the Governor, the State21
Treasurer, the chairperson of the Nebraska Investment Council, the22
chairperson of the Nebraska State Board of Public Accountancy, and a23
professor of economics on the faculty of a state postsecondary24
educational institution appointed to a two-year term on the board by the25
Coordinating Commission for Postsecondary Education. For administrative26
and budget purposes only, the board shall be considered part of the27
Department of Revenue; 28
(4) Bond means a general obligation bond, redevelopment bond, lease-29
purchase bond, revenue bond, or combination of any such bonds;30
(5) Convention and meeting center facility means a temperature-31

controlled building and personal property primarily used as a convention1
and meeting center, including an auditorium, an exhibition hall, a2
facility for onsite food preparation and serving, an onsite, directly3
connected parking facility for the use of the convention and meeting4
center facility, a nearby parking facility for the use of the convention5
and meeting center facility, and an onsite administrative office of the6
convention and meeting center facility; 7
(6)(a) Eligible facility means any publicly owned convention and8
meeting center facility approved for state assistance on or before June9
1, 2007, any publicly owned sports arena facility attached to such10
convention and meeting center facility, or any publicly owned convention11
and meeting center facility or publicly owned sports arena facility12
acquired, constructed, improved, or equipped after June 1, 2007; and13
(b) Beginning with applications for financial assistance received on14
or after February 1, 2008, eligible facility does not include any15
publicly owned sports arena facility with a seating capacity of greater16
than sixteen thousand seats unless such facility is located in a city of17
the primary class; 18
(7) General obligation bond means any bond or refunding bond issued19
by a political subdivision and which is payable exclusively from the20
proceeds of an ad valorem tax; 21
(8) Maximum aggregate appropriation means (a) one hundred fifty22
million dollars for any one approved project, but not more than the total23
cost of acquiring, constructing, improving, repairing, replacing,24
financing, or equipping the eligible facilities of the political25
subdivision, or (b) for an eligible facility located within six hundred26
yards of the State Capitol, the total cost of acquiring, constructing,27
improving, repairing, replacing, financing, and equipping such facility,28
but only to the extent the cost of acquiring, constructing, improving,29
repairing, replacing, and equipping such facility does not exceed one30
hundred fifty million dollars; 31

(9) Nearby parking facility means any parking lot, parking garage,1
or other parking structure that is not directly connected to a convention2
and meeting center facility but which is located, in whole or in part,3
within six hundred yards of a convention and meeting center facility,4
measured from any point of the exterior perimeter of such facility but5
not from any other parking facility or other structure;6
(10) Nearby retailer means a retailer as defined in section7
77-2701.32 that is located, in whole or in part, within six hundred yards8
of an eligible facility the application for which is approved on or after9
June 7, 2023, measured from any point of the exterior perimeter of the10
eligible facility but not from any parking facility or other structure,11
except that if the eligible facility is within six hundred yards of the12
State Capitol, the area used in determining nearby retailers shall be one13
or more contiguous or noncontiguous areas within the territorial14
boundaries of the applicant which are selected by the applicant and which15
aggregate the same total amount of square footage that such area would16
have contained had the eligible facility not been within six hundred17
yards of the State Capitol. The area used in determining nearby retailers18
shall be depicted on a map submitted pursuant to section 13-2605;19
(11) Political subdivision means any local governmental body formed20
and organized under state law and any joint entity or joint public agency21
created under state law to act on behalf of political subdivisions which22
has statutory authority to issue general obligation bonds;23
(12) Revenue bond means any bond or refunding bond issued by a24
political subdivision which is limited or special rather than a general25
obligation bond of the political subdivision and which is not payable26
from the proceeds of an ad valorem tax; and 27
(13) Sports arena facility means any enclosed temperature-controlled28
building primarily used for competitive sports, including arenas,29
dressing and locker facilities, concession areas, parking facilities, and30
onsite administrative offices connected with operating the facilities.31
