A BILL FOR AN ACT relating to public health and welfare; to require1
industrial integrators to develop an annual disaster mitigation plan2
for disaster events as prescribed. 3
Be it enacted by the people of the State of Nebraska,4

Section 1. (1) For purposes of this section: 1
(a) Disaster event means an infectious disease outbreak, including,2
but not limited, to avian influenza or another zoonotic disease, a3
natural disaster, or another event that substantially disrupts normal4
operations and public health; and 5
(b) Industrial integrator means a large corporation that owns and6
manages an entire livestock supply chain or animals including poultry,7
hogs, and dairy and feeder cattle, and who controls the entire production8
process, providing inputs including, but not limited to, feed, veterinary9
care, antibiotics, vaccines, and genetics, and who also contracts with10
growers who provide land, barns, and labor, effectively managing the11
supply chain from farm to market. 12
(2) An industrial integrator shall develop and submit an annual13
disaster mitigation plan to the Department of Health and Human Services14
that includes protocols for coordination and communication during a15
disaster event. The plan shall identify (a) local health departments, (b)16
hospitals, (c) emergency responders, (d) veterinary clinics, (e)17
livestock trucking and transportation companies, (f) other confined18
livestock or poultry feeding facilities with a high concentration of19
animals that may be affected by, or involved in, a coordinated response20
to an outbreak within a five mile radius of the facility, and (g) village21
or city mayors located within five miles of the outbreak.22
(3) Each disaster mitigation plan shall: 23
(a) Describe how each industrial integrator will notify and24
coordinate with the entities described in subsection (2) of this section25
in the event of a suspected or confirmed disaster event, including (i)26
procedures for reporting exposures, (ii) facilitating public health27
monitoring, including monitoring exposed individuals, and (iii)28
supporting continuity of care and emergency response if necessary;29
(b) Describe how an industrial integrator will acquire, store, and30
distribute appropriate personal protective equipment for workers,31

contractors, and responders who may be exposed during a disaster event;1
and 2
(c) Include (i) measures to prevent and control the spread of the3
infectious disease, including protocols to limit unprotected contact with4
infected animals or contaminated materials, (ii) procedures for isolating5
affected animals with measures developed to avoid wellhead protection6
areas and other local drinking water resources, and (iii) strategies to7
reduce transmission within and between facilities. 8
