A BILL FOR AN ACT relating to counties; to provide for the treatment of1
uncashed checks issued by counties as prescribed.2
Be it enacted by the people of the State of Nebraska,3

Section 1. (1) Each county treasurer and county clerk shall1
maintain a list of checks issued by his or her office that remain2
uncashed after two years, including the amount of the check and the name3
of the person to whom the check was issued. 4
(2) Any such check for an amount of less than one hundred dollars5
shall be void three years after the date of its issuance and shall cease6
to be an obligation of the county at such time. Such check may thereafter7
be presented to the county board of such county which may approve the8
claim for payment. 9
(3) Any check that is void pursuant to subsection (2) of this10
section shall be charged off upon the books of the county, and the county11
treasurer shall credit the money, including any interest thereon, to the12
general fund of such county. 13
(4) Any check that is void pursuant to subsection (2) of this14
section shall cease to be intangible personal property held for the owner15
and shall not be subject to the Uniform Disposition of Unclaimed Property16
Act. 17
