A BILL FOR AN ACT relating to the Nebraska Affordable Housing Act; to1
amend section 58-701, Revised Statutes Supplement, 2025; to provide2
requirements for multifamily housing projects to receive assistance;3
to harmonize provisions; and to repeal the original section.4

Section 1. Section 58-701, Revised Statutes Supplement, 2025, is1
amended to read: 2
58-701 Sections 58-701 to 58-712 and section 2 of this act shall be3
known and may be cited as the Nebraska Affordable Housing Act.4
Sec. 2. (1) For purposes of this section: 5
(a) Accessible has the same meaning as in 24 C.F.R. 8.3, as such6
regulation existed on January 1, 2026; and 7
(b) Multifamily housing project means a project involving the8
construction of one or more residential structures that, as a whole,9
contain five or more dwelling units. 10
(2) Beginning on the effective date of this act, the Department of11
Economic Development shall not approve a multifamily housing project for12
assistance from the Affordable Housing Trust Fund unless:13
(a) At least twenty percent of the dwelling units included in the14
project will be accessible for persons with mobility impairments; and15
(b) At least ten percent of the dwelling units included in the16
project will be accessible for persons with hearing or vision17
impairments. 18
Sec. 3. Original section 58-701, Revised Statutes Supplement, 2025,19
is repealed. 20
