SECOND SESSION
LEGISLATIVE RESOLUTION 294

NOTICE OF INTENT TO FILE ARTICLES OF IMPEACHMENT
WHEREAS, Elizabeth O'Connor currently serves on the Board of Regents of
the University of Nebraska, serving since 2019 and recently re-elected in 2024;
and
WHEREAS, Elizabeth O'Connor was in a two-vehicle crash on May 21, 2025, in
Omaha, Nebraska; and
WHEREAS, Elizabeth O'Connor was charged with driving under the influence
(DUI) causing serious bodily injury, a Class IIIA felony, after law enforcement
determined that she was operating a motor vehicle under the influence of
alcohol and that she caused the crash; and
WHEREAS, Article IV, section 5, of the Constitution of Nebraska states
that "A civil officer of this state shall be liable to impeachment for any
misdemeanor in office"; and
WHEREAS, Article III, section 17, of the Constitution of Nebraska provides
that the Legislature has "the sole power of impeachment".
NOW, THEREFORE, BE IT RESOLVED BY THE MEMBERS OF THE ONE HUNDRED NINTH
LEGISLATURE OF NEBRASKA, SECOND SESSION:
1. That the Legislature calls upon Elizabeth O'Connor to resign her seat
on the Board of Regents immediately.
2. That the Legislature hereby calls upon the Governor, pursuant to
section 32-573, Nebraska Revised Statutes, to fill Elizabeth O'Connor's vacated
seat, pending an election to fill the vacated seat.
3. That if Elizabeth O'Connor fails to resign, articles of impeachment
will be filed against her, to be heard by the Government, Military and Veterans
Affairs Committee of the Legislature.

4. That the Clerk of the Legislature is hereby directed to send, upon
passage, a copy of this resolution, by certified mail with return receipt
requested, to Elizabeth O'Connor at her last-known address.
