Subject: Transfers funds from the Corrective Action Account to the Municipal Solid Waste Remediation Account. Summary/Major Elements: Currently in statute, funds in the Corrective Action Account are expended by the Department of Environmental Quality to remediate leaking gasoline or diesel fuel storage tanks. There has historically been deposited in the Corrective Action Account between $10,000,000 and $13,000,000 a year to remediate these leaking storage tanks. The storage tank remediation program is beginning to wind down, but will require a certain amount of funds each year for new leaks and maintenance. This Act transfers a portion of the funds from the Corrective Action Account to the Municipal Solid Waste Remediation Account. The portion of funds directed to the Municipal Solid Waste Remediation Account increases from 2019 through 2023. In 2024 and thereafter, the director of the Depart ment of Environmental Quality ( DEQ) determines the amount to transfer between the two account s, based on the expected need to remediate storage tanks, but in no event shall more than $5,000,000 remain in the account after July 1 of each year. The director of the DEQ is authorized to withhold distributions from the Corrective Action Account to the Municipal Solid Waste Remediation Account: In cases of an emergency involving a leaking storage tank; If m onies in the Corrective Action Account are less than the amount required by federal law to provide financial assurance coverage or adequate remediation of underground storage tanks.
