Subject: Towing service rotation list for nonconsensual towing. Summary/Major Elements: This bill authorizes the D epartment of T ransportation to provide for removal of vehicles when the owner or operator of the vehicle is unable to assist in the removal of the vehicle including the creation of a voluntary rotation list for tow truck and recovery carriers to be used by law enforcement when vehicle towing or recovery is required. The D epartment of T ransportation is directed to adopt rules related to the list including procedures to be placed on the rotation list, minimum equipment standards for tow trucks on the rotation list, inspection of operators on the list as necessary, identification of geographical areas for operation of the list and a reprimand and suspension system for the rotational list. The bill also provides for a tow truck or recovery carrier to file a rate disclosure document which states typical fees for commonly used towing and recovery procedures and provides that in any action w here the fee charged by a towing company is in issue, the burden of proof to show the fee is fair and reasonable shall be upon the towing company.
