Subject: Procedures for reporting and addressing discrimination or sexual harassment. Summary/Major Elements: This act addresses processes for reporting discrimination, sexual harassment, and sexual assault involving the Wyoming National Guard or Wyoming Military Department. For discrimination and sexual harassment grievances under the federal laws enforced by the Equal Employment Opportunity Commission or under W.S. 27‑9‑105 ( discriminatory and unfair employment practices in the Wyoming Fair Employment Practices Act of 1965) , the act provides for coordination of the processes for reporting, counseling, mediating, investigating and making determinations between the Department of Workforce Services and the Wyoming Military Department. The act requires agreements between the Wyoming Military Department and the Department of Workforce Services, specifies duties and powers of the Department of Workforce Services and the Adjutant General, and requires them to coordinate when promulgating rules. The act also authorizes and funds a position for the Department of Workforce Services. The act also creates a procedure similar to the Uniform Code of Military Justice Article 138 procedure for complaints and redressing of wrongs. Comments: Amends a major program: amends procedures for addressing discriminatory and unfair employment practices under the Wyoming Fair Employment Practices Act of 1965. Appropriates funds from the general fund to the Department of Workforce Services. This act provides for rules to be promulgated immediately and for statutory changes to take effect July 1, 2022.
